By accessing or using the Services, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you may not use the Services.

Hacktics is operated exclusively out of the State of Nebraska.

3. Changes to Terms

Hacktics reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and become effective upon posting.

Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

4. Description of Services

Hacktics provides automation, marketing, and technology services, which may include:

CRM and lead management tools

Automated email, SMS, and voice workflows

AI-powered call handling and messaging

Marketing automation and analytics

Paid advertising management

Scheduling and appointment tools

Integrations with third-party platforms

Hacktics does not guarantee uninterrupted or error-free service. Features, integrations, and functionality may change over time.

You are solely responsible for ensuring that your use of the Services complies with applicable laws and regulations.

5. Prohibited Uses

You may not use Hacktics for:

Illegal activities or fraudulent practices

Adult content, gambling, or illegal financial services

Spamming, phishing, or sending unsolicited communications

Misrepresentation or deceptive practices

Excessive or abusive usage that degrades platform performance

Reverse engineering, hacking, or attempting to interfere with platform functionality

Training external AI models using Hacktics-generated content

Hacktics reserves the right to suspend or terminate accounts engaged in prohibited activity without refund or liability.

6. License & Intellectual Property

Hacktics provides access to its Services as a licensed software and services platform.

All software, systems, and intellectual property remain the exclusive property of Hacktics or its licensors.

Users receive a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms.

Users do not acquire ownership rights to any software, source code, or proprietary systems.

Unauthorized use, copying, modification, or resale is strictly prohibited.

7. Subscriptions, Billing & Payments

Subscription Terms

Subscriptions automatically renew unless canceled.

Payments are processed through third-party payment processors.

Failure to pay may result in suspension after 7 days and termination after 30 days of delinquency.

Usage-Based Charges

Users may incur additional charges for usage-based services, including but not limited to:

Call minutes

SMS and MMS messages

Emails

AI or automation actions

Third-party pass-through costs

These charges are calculated based on actual usage and rebilled automatically. All usage-based charges are final and non-refundable.

By using the Services, you authorize Hacktics to automatically charge your selected payment method for subscription and usage-based fees.

8. Downtime & Service Availability

Hacktics may experience downtime due to maintenance, updates, or third-party service interruptions.

Hacktics is not liable for:

Lost revenue

Business interruption

Missed calls, messages, or leads

Data delays caused by third-party providers

9. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

Hacktics is not responsible for unauthorized access resulting from weak passwords, credential sharing, or user negligence.

Notify Hacktics immediately if you suspect unauthorized use.

10. Data & User Content

Users retain ownership of data, workflows, and content they upload.

Hacktics is granted a license to store, process, and use user data solely to provide Services.

Users are responsible for ensuring they have rights to all uploaded content.

Hacktics may delete account data within 30 days of account cancellation unless retention is required by law.

11. Third-Party Integrations

Hacktics may integrate with third-party platforms and services.

Hacktics is not responsible for outages, data loss, pricing changes, or errors caused by third-party providers.

12. Privacy

Use of the Services is subject to Hacktics’ Privacy Policy, which explains how we collect and use personal information.

13. Disclaimers & Limitation of Liability

The Services are provided “as is” and “as available.”

Hacktics disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, Hacktics shall not be liable for indirect, incidental, consequential, or special damages arising from use of the Services.

14. Arbitration & Dispute Resolution

Any dispute arising from these Terms or the Services shall be resolved by binding arbitration in Lincoln, Nebraska.

You waive the right to:

Trial by jury

Class actions or representative claims

You may opt out of arbitration within 30 days of account creation by submitting written notice to Hacktics.

15. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles.

16. Termination

Hacktics may suspend or terminate access to the Services at any time for violation of these Terms.

Upon termination, all licenses granted under these Terms immediately end.
